Terms and Conditions

These Terms and Conditions (“Terms”) are issued by Qylvoro OÜ (registry code 17315512), Mooni tn 18, 10613 Tallinn, Estonia (“Company”, “we”, “our”). Itemare OÜ (registry code 17309345), Jõe tn 5, Kesklinna linnaosa, Tallinn, 10151, Estonia, acts as our technical processor under a Data Processing Agreement (Art. 28 GDPR). By accessing or purchasing from this Website, you agree to be bound by these Terms. If you do not agree, you must stop using the Website immediately.
1. Definitions
“Website” – polycrafter.org
“Products” – digital goods including 3D models, textures, animations, and related digital assets.
“User / You” – any individual or entity accessing or purchasing Products via the Website.
“Order” – the User’s request to acquire Products according to these Terms.
“Account” – a User profile created on the Website to purchase Products.
“Payment Service Provider (PSP)” – a licensed provider processing payments under Directive (EU) 2015/2366 (PSD2).
Users must be at least 16 years old or have legal capacity to enter into binding contracts.
2. Website Access and Availability
We aim to ensure that the Website is available at all times, but we do not guarantee uninterrupted access. Access may be restricted due to maintenance, updates, or technical issues. We may suspend or terminate access in cases of breach of these Terms.
3. User Account and Security
To purchase Products, you may need to create an Account. You must provide accurate and current information. You are responsible for safeguarding your credentials and all activities under your Account. We may verify your identity (KYC) for high-value purchases or to prevent fraud, in line with AML and PSD2 requirements.
4. Acceptable Use and Prohibited Conduct
You agree not to use the Website for unlawful or prohibited purposes, including:
- Infringing intellectual property rights.
- Distributing malware, spam, or harmful code.
- Gaining unauthorized access to systems.
- Engaging in scraping, data mining, or automated access.
- Circumventing licenses or sharing access with third parties.
- Accessing the Website from jurisdictions under sanctions (Russia, Belarus, Iran, Syria, North Korea).
5. Payments (PSD2 / SCA)
All prices are displayed on the Website. VAT is not included. Payments must be made in advance. Payments are processed by licensed Payment Service Providers (PSPs) in accordance with PSD2 (Directive (EU) 2015/2366). Strong Customer Authentication (SCA) may apply, including 3‑D Secure verification. We do not store payment card numbers or CVV codes. Transaction fees imposed by payment providers are borne by the User.
6. Delivery of Digital Products
Products are delivered electronically after successful payment. Delivery is considered completed once the download link or license key is provided. By initiating download or activation, you expressly waive your right of withdrawal under Directive 2011/83/EU.
7. License
We grant you a limited, non-exclusive, non-transferable license to use the Products for permitted purposes. You may not redistribute, sublicense, resell, or claim authorship of the Products. Your statutory rights for defective digital content under Directive (EU) 2019/770 remain unaffected.
8. Refunds and Consumer Rights
Refunds are governed by our Refund & Return Policy: https://polycrafter.org/refund-return-policy. EU consumers have a statutory right to withdraw within 14 days unless they request immediate access. If the digital content is defective or non-conforming, you have the right to remedies (repair, replacement, price reduction, or contract termination) under Directive (EU) 2019/770.
9. AML, Fraud Prevention, and Chargebacks
We may request verification of your identity or payment details under applicable AML regulations. Before initiating a chargeback or dispute, please contact support@polycrafter.org to resolve the issue. We reserve the right to suspend access during dispute resolution or investigations.
10. Intellectual Property
All content on the Website, including text, graphics, source code, and digital assets, is owned or licensed by Qylvoro OÜ or its partners. You may not copy, modify, or distribute any content without prior written authorization.
11. Third-Party Links
The Website may contain links to third-party sites for convenience. We are not responsible for their content, availability, or data practices.
12. Privacy and GDPR Compliance
We process personal data in accordance with Regulation (EU) 2016/679 (GDPR) and the Estonian Data Protection Act. See our Privacy Policy at https://polycrafter.org/privacy-policy for details on lawful bases, data transfers (SCC/DPF), and retention periods.
13. Disclaimers and Limitation of Liability
The Website and Products are provided “as is” without warranties of any kind. Nothing in these Terms limits or excludes liability for fraud, gross negligence, or death/personal injury caused by our negligence. To the maximum extent permitted by law, our liability is limited to the amount paid for the Product.
14. Changes to Website and Terms
We may modify or discontinue parts of the Website and update these Terms at any time. Updates will be published with a new effective date. Continued use after updates constitutes acceptance of the revised Terms.
15. Governing Law and Jurisdiction
These Terms are governed by the laws of Estonia. EU consumers may bring claims in their country of residence under Regulation (EU) 1215/2012 (Brussels I Recast).
16. Language
These Terms are written in English. In case of discrepancies between translations, the English version prevails.
